1. Definitions
In these Terms and Conditions:
- "Service" refers to the Thai massage and bodywork treatments provided by Pearlwind
- "Client" or "You" refers to any individual receiving services or using our website
- "We," "Us," or "Pearlwind" refers to the massage therapy practice operating at Guangfu Road, No. 341, Taoyuan 330, Taiwan
- "Practitioner" refers to trained massage therapists employed by Pearlwind
- "Agreement" refers to these Terms and Conditions along with our Privacy Policy
2. Acceptance of Terms
By booking an appointment, receiving treatment, or using our website, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
You must be at least 18 years of age to book and receive services independently. Minors may receive treatment only with parental or guardian consent and presence.
If you do not agree to these terms, please do not use our services or website.
3. Service Description
Pearlwind provides Thai massage and bodywork services as described on our website and in our communications. Services include:
- Hot Stone and Thai Combination treatments
- Back and Spine Focused treatments
- Tension Relief Focus sessions
All services are therapeutic bodywork and are not medical treatments. Massage therapy should not replace medical care or professional health advice.
We reserve the right to modify service offerings, pricing, and availability at our discretion with appropriate notice to existing clients.
4. Booking and Appointments
4.1 Scheduling
Appointments can be scheduled by phone, email, or through our website. All bookings are subject to practitioner availability.
4.2 Confirmation
You will receive confirmation of your appointment via email or phone. Please verify the date, time, and service type upon booking.
4.3 Arrival
Please arrive 5-10 minutes before your scheduled appointment time to complete intake forms if this is your first visit. Late arrival may result in shortened session time or rescheduling.
4.4 Cancellation Policy
We require at least 24 hours notice for cancellations or rescheduling. Cancellations made with less than 24 hours notice may be subject to a cancellation fee of up to 50% of the service price. No-show appointments will be charged the full service fee.
5. Client Responsibilities
5.1 Health Disclosure
You must provide accurate information about your health status, medical conditions, injuries, and any contraindications to massage therapy. Failure to disclose relevant health information may compromise treatment safety.
5.2 Communication
You are responsible for communicating your comfort level, pressure preferences, and any discomfort during treatment. The practitioner cannot adjust treatment appropriately without your feedback.
5.3 Conduct
Clients are expected to behave respectfully toward practitioners and staff. Inappropriate behavior, including but not limited to sexual advances, harassment, or aggression, will result in immediate termination of service without refund.
6. Payment Terms
6.1 Pricing
All prices are listed in Taiwan Dollars (TWD) and are subject to change. Current pricing is available on our website and upon inquiry.
6.2 Payment Methods
We accept cash, credit cards, and other payment methods as posted at our facility. Payment is due at the time of service unless other arrangements have been made in advance.
6.3 Refunds
Refunds are provided at our discretion if you are dissatisfied with service quality. Refund requests must be made within 48 hours of the session. Refunds are not provided for personal preference regarding technique or practitioner style when these were discussed during pre-session consultation.
7. Treatment Protocols
7.1 Scope of Practice
Our practitioners provide massage therapy within their scope of training. We do not diagnose medical conditions, prescribe medications, or provide medical treatment.
7.2 Contraindications
Massage therapy may not be appropriate for certain health conditions. The practitioner reserves the right to decline or modify treatment if contraindications are present.
7.3 Professional Boundaries
All sessions are conducted with appropriate draping and professional boundaries. The therapeutic relationship is strictly professional.
8. Intellectual Property
All content on our website, including text, images, logos, and design elements, is the property of Pearlwind or used with permission. You may not reproduce, distribute, or create derivative works from our content without written permission.
You are granted a limited, non-exclusive license to access and use our website for personal, non-commercial purposes only.
9. Disclaimers
9.1 Service Disclaimer
Services are provided on an "as is" basis. While we strive for quality, we make no guarantees regarding specific outcomes or results from treatment.
9.2 Medical Disclaimer
Massage therapy is not a substitute for medical examination, diagnosis, or treatment. Always consult with your healthcare provider regarding health concerns.
9.3 Website Accuracy
While we endeavor to keep information on our website current and accurate, we make no representations about the completeness or accuracy of information provided.
10. Limitation of Liability
To the maximum extent permitted by Taiwan law, Pearlwind's liability for any claim arising from services provided is limited to the amount paid for the specific session in question.
We are not liable for indirect, incidental, consequential, or punitive damages arising from your use of our services.
This limitation applies whether the claim is based in contract, tort, negligence, strict liability, or any other legal theory.
11. Indemnification
You agree to indemnify and hold harmless Pearlwind, its practitioners, employees, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from your violation of these Terms and Conditions or your use of our services.
12. Privacy
Your use of our services is also governed by our Privacy Policy. Please review our Privacy Policy to understand how we collect, use, and protect your personal information.
13. Governing Law and Dispute Resolution
These Terms and Conditions are governed by the laws of Taiwan. Any disputes arising from these terms or our services shall be subject to the exclusive jurisdiction of the courts in Taoyuan, Taiwan.
Before initiating formal legal proceedings, parties agree to attempt informal resolution through direct communication.
14. General Provisions
14.1 Entire Agreement
These Terms and Conditions, together with our Privacy Policy, constitute the entire agreement between you and Pearlwind regarding use of our services.
14.2 Severability
If any provision of these terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
14.3 Waiver
Our failure to enforce any provision of these terms does not constitute a waiver of that provision or any other provision.
14.4 Assignment
You may not assign or transfer your rights or obligations under these terms. We may assign our rights and obligations to a successor entity.
